US H2B Cap For First Half Of FY 2019 Reached

The statutory H2B cap for the first half of FY 2019 has been reached.

USCIS has announced December 16, 2018 as the final receipt date for new H2B petitions requesting an employment start date before April 1, 2019. USCIS will reject new cap-subject H2B petitions received after December 06 that request an employment start date before April 1, 2019.

USCIS is currently accepting cap-subject petitions for the second half of FY 2019 for employment start dates on or after April 1, 2019.

USCIS also continues to accept H2B petitions that are exempt from the cap, including petitions on behalf of current H2B workers in the U.S. requesting an extension of stay, change in terms of employment, or change of employers.
