U.S. Citizenship and Immigration Services (USCIS), as of April 13, 2009 had received only 43,000 petitions towards the 65,000 standard H-1B quota for Fiscal Year (FY) 2010 . Since its last count on April 9, the agency has received approximately 1,000 new H-1B cap petitions.
USCIS, last week informed that it had already received 20,000 petitions filed under the cap exemption for foreign nationals holding U.S. advanced degrees. While only 20,000 advanced-degree cases are exempt from the standard H-1B cap, USCIS will nevertheless continue to accept new advanced-degree and standard cap filings until the overall annual limits for the H-1B category are reached.
