Form I-129F (K-3-spouse of U.S. Citizens only) transferred by USCIS

Effective October 23, 2006, USCIS National Benefits Center has begun transferring K-3 petitions to the California Service Center (CSC) and the Vermont Service Center (VSC), depending on the location of the related Form I-130, Petition for Alien Relative.

USCIS issued a guidance memo for field officers regarding the amendments made by the International Marriage Broker Regulation Act (IMBRA) to sections 214(d) and 214(r) of the INA.
USCIS to issue RFEs for over 10,000 Fiancé(e) petitions

In order to comply with provisions of the International Marriage Brokers Regulation Act of 2005 (IMBRA), USCIS will need to issue “Requests for Evidence” for more than 10,000 Alien Fiancé(e) Petitions (Form I-129F) currently being held at USCIS Service Centers.
DOS returns 1,100 Fiancé(e) petitions

DOS has announced that it has returned to the NVC approximately 1,100 K-1 petitions that were filed on or after March 6, 2006, due to Department of Homeland Security (DHS) failure to collect criminal background information.
USCIS announces new policy regarding V Status Extension
May 16, 2005
U.S. Citizenship and Immigration Services (USCIS) announced today that valid V-2 and V-3 status holders will no longer “age-out” of V-2 or V-3 status. USCIS will now approve extension of status applications for children of lawful permanent residents who are 21 years old or older with V-2 or V-3 status, as long as they meet the requirements for extension of status in every other way.
USCIS Memo on exception to HIV Waiver policy for K and V nonimmigrants

William Yates, USCIS Associate Director of Operations recently issued a memorandum clarifying USCIS policy on the eligibility for discretionary waivers of inadmissibility due to HIV infection for K and V nonimmigrants.
USCIS invites public comments on information collection in Fiance(e) petitions

USCIS has published a notice inviting comments from the public and affected agencies concerning the proposed collection of information in Petitions for alien fiance (Form I-129F), for review and clearance in accordance with the Paperwork Reduction Act of 1995.
