USCIS Announces Fee Increases for First Time in Six Years

USCIS has announced the publication of a final rule in the Federal Register increasing USCIS fees for the vast majority of USCIS petitions and applications. The fee changes will become effective on Friday, December 23, 2016. All applications received on or after December 23, 2016 must contain the new fee amount or the application will be rejected by USCIS.
USCIS Publishes New Form I-131A, Application for Travel Document (Carrier Documentation)

USCIS has published a new Form I-131A, The new form is available to lawful permanent residents (LPRs) to apply for a carrier document if they are returning from temporary overseas travel of less than one year, and their Green Card has been lost, stolen or destroyed; or if they are returning from temporary overseas travel of less than two years, and their Reentry Permit has been lost, stolen or destroyed.
Change In Filing Address For Certain H-1B and H-1B1 Petitions

H-1B employers must keep in mind the recent change in filing address for certain H-1B and H-1B1 petitions. Starting September 1, 2016, certain H-1B and H-1B1 petitions are to be filed at Nebraska Service Center alone.
FY 2017 H1B Cap Update: USCIS Returns Petitions Not Selected in the H1B Lottery

USCIS has announced that it has completed processing the return of FY 2017 H1B Cap-subject petitions that were not selected in the H1B Lottery. Employers who have submitted an H-1B Cap-subject petition between April 1 and April 7, 2016 have been advised to contact USCIS if they do not receive a receipt notice or a returned petition by July 22, 2016.
Nebraska Service Center to Accept Certain H-1B1 and H1B Petitions

Starting July 1, 2016, Nebraska Service Center will begin accepting certain Form I-129 H1B petitions and H-1B1 petitions on behalf of Chileans and Singaporeans. Currently, all H-1B1 petitions on behalf of Chileans and Singaporeans are filed at the Vermont Service Center, and all H1B petitions are filed at the Vermont Service Center or California Service Center depending on the work location.
Form I-129 Petition Seeking Extension of Status or Change of Employer Pending for Over 210 Days: Petitioners May Now Submit Inquiries With USCIS

Employers who have filed a Form I-129 petition seeking extension of status or change of employer may now submit an inquiry with USCIS if their I-129 petition has been pending for 210 days or more.
H-2A Visa Updates: USCIS Launches e-Approval; Will Use Pre-paid Mailers To Send Receipt Notices

USCIS has announced two significant changes in processing of Form I-129 petitions for H-2A visa classification. Starting May 11, 2016, USCIS will send approval information for H-2A petitions to DOS electronically, and DOS will accept this electronic information in place of a Form I-797 Approval Notice. USCIS will also begin using pre-paid mailers provided by petitioners to send out receipt notices for H-2A petitions.
USCIS Publishes Optional Checklists For Forms I-129F and I-765 Filing

USCIS has published on its website, optional checklists for Form I-129F (Petition for Alien FiancÚ(e)), and Form I-765 (Application for Employment Authorization) to assist applicants in the submission of related form packages. The USCIS optional checklists will help applicants identify documents they need to include and important items they need to complete in the form.
DHS Proposes Increase In Certain USCIS Filing Fees

Department of Homeland Security is proposing to increase certain immigration and naturalization fees charged by USCIS and has invited public comments. After the 60-day comment period that expires on 07/05/2016, USCIS will address the comments received and publish a final rule.
FY 2017 H1B Cap Update: USCIS Completes Data Entry Of Petitions Selected In H1B Lottery

USCIS has completed data entry of all FY 2017 H1B Cap petitions selected in the H1B lottery, and will now begin returning H1B Cap petitions that were not selected in the 2016 H1B lottery. USCIS is also transferring some 2016 H1B Cap petitions from the Vermont Service Center to the California Service Center. Petitioners whose cases are transferred will receive a notification in the mail in this regard.
