USCIS Announces Extension of Filing Time for O & P Nonimmigrant Petitions

U.S. Citizenship and Immigration Services (USCIS) give petitioners more time to bring foreign workers with extraordinary abilities to the United States. Petitioners can file nonimmigrant petitions “O” and “P” up to one year before a scheduled event, competition or performance, under normal processing procedures. USCIS is making the change through a final rule that was transmitted to the Federal Register for publication on April 16, 2007.
USCIS updates count of FY 2008 H1B Cap Filings

U.S. Citizenship and Immigration Services (USCIS) announced an updated number of filings today as the counting of H1B petitions received on April 2 and 3 continues. On April 3, USCIS announced that it had received enough petitions to meet the congressionally mandated cap for fiscal year 2008 (FY 2008) and that it would conduct a computergenerated random selection of capsubject petitions filed on Monday (April 2) and Tuesday (April 3) to determine which cases would be accepted for processing.
USCIS imposes conditions on availability of premium processing for H1B petitions subject to the FY 2008 Cap

U.S. Citizenship and Immigration Services (USCIS) announced today that the 15day premium processing period for petitions subject to the fiscal year 2008 (FY 2008) congressionally mandated H1B cap will begin after the computergenerated random lottery has selected the petitions for processing. USCIS announced on April 3, 2007 that it had received enough H1B petitions to meet the FY 2008 cap.
USCIS Reaches H2B Cap For Second Half of FY 2007

U.S. Citizenship and Immigration Services (USCIS) has announced today that it has received a sufficient number of petitions to reach the congressionally mandated H2B cap for the final six months of fiscal year 2007 (FY 2007). The USCIS has notified the public that March 16, 2007 is the “final receipt date” for new H2B worker petitions requesting employment start dates prior to October 1, 2007. The “final receipt date” is the date on which USCIS expects that it would have received enough capsubject petitions to reach the limit of 33,000 H2B workers for the second half of FY 2007.
Premium Processing Service suspended for R1 applications

U.S. Citizenship and Immigration Services (USCIS) has temporarily suspended Premium Processing Service for I129 petitions seeking R1 nonimmigrant visa classification filed with the USCIS.
Extension of H2B Returning Worker exemption

USCIS has announced that the “returning worker” exemption to the H2B numerical limitation has been extended by the National Defense Authorization Act for Fiscal Year 2007. The one year extension of the “returning worker” provisions will remain in effect until September 30, 2007.
89 “leftover” H1Bs available

USCIS has informed that 89 H1B numbers out of the 6,800 reserved for Chile and Singapore nationals are available for distribution among those who missed out on the H1B Cap for FY 2007.
President signs Bill enacting H2B relief

The bill includes a one year extension of the returning worker exemption to the H2B visa cap. The extension takes effect beginning October 1, 2006.

U.S. Citizenship and Immigration Services (USCIS) has reported that it has received 15,817 H2B petitions counting towards the H2B Cap for the first half of FY 2007, which is approximately onehalf of the 33,000 numbers set aside for the 1st half of FY 2007.

U.S. Citizenship and Immigration Services (USCIS) has reported that it has received 9,002 H2B petitions counting towards the H2B Cap for the first half of FY 2007.
