01/12/2004 | "Both you and your conditional permanent resident spouse are required to file a petition, Form I-751, Joint Petition to Remove the Conditional Basis of Alien's Permanent Resident Status, during the 90-day period immediately before the second anniversary of the date your alien spouse was granted conditional permanent residence." [INS]
Here are the questions:
1) What is this 2 year anniversery? 2) Is it 2 years after the wedding? 3) Is it 2 years after you received the conditional green card and would it be the same as of two years after wedding? 4) For example if someone gets married in January 2000 and gets his conditional green card in January 2001 would that mean he is ready to remove his condition in January 2002 or January 2003?
Please help

01/12/2004 | Hi Dr. It is two years of the date the foreign spouse has been granted conditional LPR. The temporary GC has that date on it. If that date happens to be January 2, 2001, then the I-751 should be filed between October 4, 2002 and January 2, 2003 irrespective of the date of marriage. Cheers! | | Re: | Joanne
01/13/2004 | I was told by INS that its your wedding anniversary they go by. We were married on May 2, 2001 and they told us that we'd have to file the I-751 90 days before our 2nd anniversary. | | Re: | Ron

If in doubt, please refer to the filing instructions pg. 2 under headline "When to File". It says that you need to file within the 90 day period prior to expiration your conditional residency. The clock for your conditional residency starts ticking when you are accorded conditional resident status. This has NOTHING to do with the date of your marriage. But don't take my words for it - see the instructions for yourself:
