01/23/2004 | Hi, I have L1 visa and am thinking of applying for green card. I heard that I'll have to wait for one year after obtaining L1 visa. Is this true? Also, can I still apply for green card even if I'm not an executive?

01/24/2004 | If you are an L-1A and worked 1 of the last 3 years for your company abroad, and your company in the U.S. has been in existence for at least 1 year, you can "dual intent" with an I-140 and I-485 filed concurrently. As long as you are in status as an L-1A you can work and travel in that status while the I-485 is pending. If the L-1A is about to expire, you have to either extend or obtain an EAD through an I-765 and a parole travel document with a form I-131. If you are not an L-1A, you will probably need a Labor Cert from DOL before the I-140 and I-485 can be filed. The labor cert is a lengthy process. | | Re: | yulin
