B. TN Status For Teachers

Upon admission into the U.S. under TN classification, Canadian and Mexican national teachers may be granted TN status for a period of up to three years initially.

NOTE: Due to reciprocity restrictions, Mexican nationals can only obtain TN visas in 1 year increments. The TN visa holder may be admitted for up to 3 years on entry.

The spouse and children under the age of 21 may be eligible for TD nonimmigrant status. Dependents do not necessarily have to be citizens of Canada or Mexico. TD status holders cannot work while in the U.S., but are permitted to study.

DID YOU KNOW?

1.The TN visa category is restricted only to citizens (not permanent residents) of Canada and Mexico.

2.If applying from abroad, Canadian nationals are not customarily required to obtain a TN visa and may apply directly at a U.S. Port of Entry with the requisite documentation.

3.Mexican citizens are required to obtain a TN visa at a U.S. Consulate or Embassy.

Conclusion

The TN Visa classification offers numerous advantages to Canadian and Mexican national teachers desirous of teaching in the United States at the postsecondary level.

Unlike the H-1B, the TN visa category is not subject to any numerical limits. Furthermore, Canadian Citizens can directly apply for admission at a U.S. port of entry and seek TN status. There is also no cap on the maximum period of stay a Canadian or Mexican teacher could spend under TN status, and qualifying applicants can seek unlimited extensions of their TN status as long as they qualify for the TN classification.
