Request For Premium Processing Service

Introduction

Employers may use this form to request faster processing of certain employment-based petitions and applications. The Form I-129, Petition for a Nonimmigrant Worker and Form I-140, Immigrant Petition for Alien Worker, have been designated for Premium Processing Service; however, not all designated classifications within these forms are eligible for Premium Processing Service, and the R-1 classification is only eligible after a successful on-site inspection at the location of employment.

Filing Fee

$2,805 if you are requesting premium processing of Form I-129 requesting E-1, E-2, E-3, H-1B, H-3, L (including blanket L-1), O, P, Q, or TN nonimmigrant classification.

$1,685 if you are requesting premium processing of Form I-129 requesting H-2B or R nonimmigrant classification.

$2,805 if you are requesting premium processing of Form I-140 requesting EB-1, EB-2, or EB-3 immigrant visa classification.

$1,685 if you are requesting premium processing of Form I-765 with eligibility category (C)(3)(A), (C)(3)(B), or (C)(3)(C).

$1,965 if you are requesting premium processing of Form I-539 seeking change of status to F-1, F-2, M-1, M-2, J-1, or J-2 nonimmigrant status.


Edition Date

02/26/24. Starting April 26, 2024, we will only accept the 02/26/24 edition. Until then, you can also use the 11/03/22 E and 11/03/22 editions

You may be eligible to file this form electronically.

Note :

If you are requesting Premium Processing on a form type and classification that is Premium eligible, the $2,500 Premium Processing fee is required in addition to all other filing fees required by the application to be processed. Checks should be made payable to U.S. Department of Homeland Security.

Religious Workers (R-1):

For I-129 petitions seeking R-1 classification – USCIS accepts Form I-907 only from those petitioners who have previously completed a successful on-site inspection at the location where the beneficiary will be employed.

Form I-129:

Customers may e-File the standalone Form I-907, Request for Premium Processing, for a previously filed I-129.

Do not send requests for Premium Processing to a USCIS Lockbox facility.
