FY 2017 H1B Cap Update: USCIS Returns Petitions Not Selected in the H1B Lottery

USCIS has announced that it has completed processing the return of FY 2017 H1B Cap-subject petitions that were not selected in the H1B Lottery.

Employers who have submitted an H-1B Cap-subject petition between April 1 and April 7, 2016, have been advised to contact USCIS if they do not receive a receipt notice or a returned petition by July 22, 2016.

With the H-1B cap exhausted, employers (except cap-exempt organizations) desirous of filing a new H1B petition will now have to wait until April 1, 2017 to be able to file again for a start date no sooner than October 1, 2017.
