FY 2021 H1B Cap Petitions May Now Be Filed With USCIS

FY 2021 H1B cap petitions that are based on H1B cap registrations selected in the FY 2021 H1B lottery could now be filed with USCIS. USCIS has announced that nearly 275,000 registrations were submitted during the initial H1B cap registration period between March 1 and March 20, and petitioners whose registrations were selected in the random selection process are now eligible to file an H1B cap petition against the selected registrations.

The period for filing the H1B cap petition will be at least 90 days, and petitioners must ensure to properly file the H1B cap petitions within the period indicated on the relevant registration selection notice. As online filing is not available for H1B petitions, petitions must be mailed to the appropriate service center listed on the registration selection notice. Petitioners must also ensure to include a printed copy of the application registration selection notice along with the H1B cap petition.

Petitioners filing H1B cap petitions must keep in mind that selection in the registration process does not relieve them from submitting evidence or otherwise establishing eligibility for petition approval, and they must ensure to establish eligibility for petition approval at the time the H1B cap petition is filed.
