DHS Extends EAD To Certain H4 Dependent Spouses

Starting May 26, 2015, DHS is extending eligibility for Employment Authorization (EAD) to certain H-4 dependent spouses of H-1B nonimmigrants seeking employment-based lawful permanent resident (LPR) status.

Eligible individuals include certain H-4 dependent spouses of H-1B nonimmigrants who:

  • Are the principal beneficiaries of an approved Form I-140, Immigrant Petition for Alien Worker; or
  • Have received one-year extension of H-1B status beyond the sixth year under the American Competitiveness in the 21st Century Act of 2000, based on a filed I-140 or labor certification.

USCIS will begin accepting H-4 EAD applications no earlier than May 26, 2015.
