Labor Unions Can Now Directly Send Negative P Visa Consultations To USCIS

USCIS is now accepting copies of negative consultation letters directly from labor unions relating to P non-immigrant visa petition submissions.

In general, USCIS requires a consultation letter, also known as the advisory opinion, from a U.S. labor organization for P visa petitions. The necessary P visa consultation is submitted by the petitioner with the P visa petition. While that process requirement remains unchanged, labor unions can now send copies of negative P visa consultation letters directly to USCIS. The negative consultation letters must include the beneficiary’s name and the last five digits of the beneficiary’s passport number and must be sent to UnionConsultationMailbox@uscis.dhs.gov.
