Labor Unions Can Now Directly Send Negative P Visa Consultations To USCIS

USCIS is now accepting copies of negative consultation letters directly from labor unions relating to P non-immigrant visa petition submissions.

In general, USCIS requires a consultation letter, also known as the advisory opinion, from a U.S. labor organization for P visa petitions. The necessary P visa consultation is submitted by the petitioner with the P visa petition. While that process requirement remains unchanged, labor unions can now send copies of negative P visa consultation letters directly to USCIS. The negative consultation letters must include the beneficiary’s name and the last five digits of the beneficiary’s passport number and must be sent to [email protected].
