USCIS has announced that it will implement the new H1B Cap Registration Process for the upcoming FY 2021 H1B Cap filings. U.S. employers who wish to file H1B cap petitions under the FY 2021 H1B cap will now have to first register under the new electronic registration system and pay a $10 H1B registration fee for each petition.
Under the new process, employers seeking to file H1B Cap petitions will have to complete a registration process that will require basic information about the company and each beneficiary. The initial registration period will be open from March 1, 2020 to March 20, 2020. USCIS will be posting step-by-step instructions on how to complete the registration process. If necessary, the H1B lottery will then be run on the electronic registrations and only those registrations that are selected in the H1B lottery will be eligible to file H1B cap petitions. If USCIS does not receive enough registrations and subsequent petitions projected to reach the H1B Cap, it may continue accepting registrations or open an additional registration period.
The Department of Homeland Security will publish a notice to formally announce implementation of the H1B registration system and is expected to provide additional details on the process.
