FY 2021 H-1B Cap Reached: USCIS Completes Registration Selection Process

USCIS has announced that it has received enough H-1B cap registrations to reach the FY 2021 H-1B cap during the initial H-1B registration period that ended on March 20, 2020. USCIS has also conducted the H-1B lottery and has randomly selected from among the registrations properly submitted.

Petitioners whose registrations were selected in the lottery will be notified of the selection before March 31, 2020, and they will be eligible to file the H-1B cap-subject petition for the beneficiary named in the selected registration. Only petitioners with selected registrations may file FY 2021 H-1B cap petitions, and only for the beneficiary in the applicable selected registration.

One of the following statuses will be shown against each registration in the H-1B registrant’s online account:

  • Selected: The registration is selected and the petitioner may file the FY 2021 H-1B cap petition on behalf of the Beneficiary.
  • Submitted: The registration remains in consideration for selection.
Note: Registrations that are shown as ‘Submitted’ will remain in consideration for selection until the end of the fiscal year, at which point all registration statuses will be Selected, Not Selected, or Denied.
  • Denied: The registration was denied because a duplicate registration was submitted by the same registrant for the same beneficiary, or a payment method was declined and not reconciled.
Note: If the registration is denied as a duplicate registration, all registrations submitted by the petitioner for the beneficiary for the fiscal year are invalid.

We will continue to monitor developments related to the FY 2021 H-1B Cap filings and will keep our readers updated.
