USCIS To Issue 2-Year EADs To Adjustment Of Status Applicants

USCIS has recently announced that it is increasing the validity period for initial and renewal Employment Authorization Documents (EADs) for certain Adjustment of Status (AOS) applicants from one year to two years.

An AOS applicant may, along with Form I-485 AOS application, file a Form I-765 seeking an EAD to be able to work in the U.S. while the AOS application is pending. USCIS currently issues EADs that are valid for 1 year to such AOS applicants. Under the new Policy, USCIS will now issue initial and renewal EADs that are valid for 2 years to such AOS applicants. It must be noted that applications for issuance of Replacement EADs will not be extended this benefit. USCIS will continue to issue Replacement EADs with the same validity dates as the original EAD.
