Starting January 30, 2023, USCIS will accept Premium Processing requests concurrently filed with Form I-140 Immigrant Petitions under EB-1.3 Multinational Executives and Managers, and EB-2 National Interest Waiver (NIW) Green Card categories. USCIS will also begin to accept requests to upgrade to Premium Processing any pending I-140 petition filed under EB-1.3 and EB-2 NIW Green Card categories. The request for Premium Processing must be made using Form I-907, Request for Premium Processing Service.
USCIS has also announced that
- in March, it will expand Premium Processing to certain F-1 students seeking Optional Practical Training (OPT) and STEM OPT extensions who have a pending application for Employment Authorization (EAD)
- in April, it will expand Premium Processing to F-1 students seeking OPT and STEM OPT extensions who are filing an initial Form I-765 for EAD
While USCIS has announced that it is working towards making Premium Processing available for Form I-539 applications for extension of stay and change of status, no specific dates have been suggested for its implementation.
