Starting January 30, 2023, USCIS will accept Premium Processing requests concurrently filed with Form I-140 Immigrant Petitions under EB-1.3 Multinational Executives and Managers, and EB-2 National Interest Waiver (NIW) Green Card categories. USCIS will also begin to accept requests to upgrade to Premium Processing any pending I-140 petition filed under EB-1.3 and EB-2 NIW Green Card categories. The request for Premium Processing must be made using Form I-907, Request for Premium Processing Service.
USCIS has also announced that
- in March, it will expand Premium Processing to certain F-1 students seeking Optional Practical Training (OPT) and STEM OPT extensions who have a pending application for Employment Authorization (EAD)
- in April, it will expand Premium Processing to F-1 students seeking OPT and STEM OPT extensions who are filing an initial Form I-765 for EAD
While USCIS has announced that it is working towards making Premium Processing available for Form I-539 applications for extension of stay and change of status, no specific dates have been suggested for its implementation. We will continue to monitor the developments in this regard and will update our readers when the Premium Processing service is further expanded.
